Mental Health Parity Act
Effective 11/01/09, for new and renewing large groups (51+ employees), the new federal Mental Health Parity Act requires that any non-severe mental health or substance use disorder benefits be offered and/or included at parity with like medical benefits (office visits or inpatient).
- This means that any financial or usage restrictions may no longer apply to these benefits if there are no restrictions in comparable medical benefits.
- The law did not change currently mandated severe mental health and detoxification benefits, or add any new mandates.
Brokers with large groups renewing 11/01/09 (or later) should take note of the non-severe mental health and substance use disorder benefit changes outlined in the renewal. This information will also be included in the group renewal packet.
